Mundo Gamer Jobs is owned and operated by Mundo Gamer Empreendimentos Tecnológicos LTDA, operating under the trade name Mundo Gamer Network. All services, whether paid or unpaid, are provided subject to these business terms. Mundo Gamer Empreendimentos Tecnológicos LTDA is a company registered in Brazil under CNPJ: 35.793.772.0001-02.

1 - DEFINITIONS

In the following terms and conditions:

  • "Agreement" refers to the list of Services both the Client and the Company have agreed to be provided to the Client by the Company, in exchange for payment;
  • "Candidate" is a general term for anyone who registers their details on our Site with the aim of finding a job, at any time in the past, present, or future;
  • "Candidate Database" means the collection of individuals who have, at some point, registered on the Site with the purpose of finding employment through it;
  • "Client" refers to any person, company, organization, or firm that purchases Services from the Company or uses the company's Services on a trial basis;
  • "Company" means Mundo Gamer Empreendimentos Tecnológicos LTDA and any subsidiary, partner, or business relation specifically related to the Site;
  • "Term of the Agreement" refers to the full term specified in the Sales Order Form;
  • "Job" or "Job Vacancy" refers to a vacancy posted by the Client;
  • "Recruitment Advertising" is a term used to describe the advertisement of a specific job vacancy relevant to the Client, via the Site;
  • "Sales Order Form" refers to an order for Services in a form provided by the Company (in any format) and signed/agreed upon by a Client (in any format, including email confirmation);
  • "Services" refers to all recruitment advertising products and services made available by the Company through its Site;
  • "Site" refers to http://www.mundogamerjobs.com or any of its subsidiary sites.
     

2 -COMPANY DESCRIPTION

In the context of these Terms and Conditions, Mundo Gamer Empreendimentos Tecnológicos LTDA is an Online Recruitment Advertising Company specific to the Gaming Industry, where Candidates apply for jobs posted by Clients and Clients search through Candidate resumes and contact them about Job Vacancies.

3- COMMENCEMENT OF SERVICES

The Company will not begin providing Services in accordance with any Sales Order Form until the said document has been verified, signed, and returned to the Company. Sales Order Forms returned are accepted via email or postal mail.

4 - PRICES AND CREDITS

  • Credits: The system operates based on credits for job posting, renewal, and promotion of job listings. Users can purchase credits individually or in packages.
  • Credit Validity: All purchased credits are valid for 360 days from the date of purchase.
  • Credit Management: It is the responsibility of the company's representative to manage their credits and access to the use of credits by their representatives. The Company is not responsible for managing the credits on behalf of the Client’s representatives.


5- RECRUITMENT ADVERTISING

A job posted on the Site will remain active for 30 days or for a shorter period, as agreed upon with the Client.

  • Extension of Posting Duration: The extension of a job's duration must be done through the use of a job renewal credit. If a new job is created, a new credit will be required for a new posting.
  • Any additional job postings beyond the agreed number will be charged with an additional credit.
  • A single job is identified by its unique ID number.
  • If a Client deletes a job and later republishes it or posts another, this will be classified as two job postings.
  • The Client is solely responsible for the accuracy and completeness of the information contained in the job listings.


6- ADVERTISERS

The Site may contain links to third-party websites and/or display third-party advertisements. The content of these sites and advertisements is the responsibility of the respective owners. The Company does not endorse or assume responsibility for any content, product, or service offered by third parties.
The Company reserves the right to remove, without prior notice, any advertisement it deems inappropriate or in violation of the Site’s policies.

7 - PAYMENT FOR SERVICES

All service prices advertised exclude VAT/Sales Tax.
Services must be paid for in advance via Credit/Debit Card using the Stripe or PayPal gateways unless otherwise agreed. Recurring monthly agreements can be paid via Standing Order or recurring Credit/Debit Card charges. Card payments will incur a 3% fee.
For each transaction, an invoice and/or statement will be issued to the Client, against which payment is due.
Late payment for Services may incur interest, accumulating at a rate of 8% above the Central Bank of Brazil's base rate at the time.
Payment for Services must be made according to the details outlined before the start of the contract.
All services are final and non-refundable.
In cases where payment is not made via credit/debit card at the time of booking, our payment terms are 30 days.

8 - TERMINATION

Termination by the Company: The Company reserves the right to terminate the provision of services at any time and for any reason, without prior notice, as necessary. Purchased credits are non-refundable and expire 360 days from the date of purchase.
In a credit-based system, there is no direct contract with Clients. Therefore, termination may occur at any time without prior notice. It is the responsibility of the Client to manage their credits and access for their representatives until the termination date.

9 - LIMITATION OF LIABILITY

The Company’s total liability to the Client in relation to any Services, except for death or personal injury caused by the Company’s negligence, is limited to the total amount paid to the Company during the validity period of the credits used for such Services or R$30,000.00 (thirty thousand reais), whichever is greater.

10 - SITE RULES

There are rules regarding the content and format of job postings on the Site. The goal is to ensure that visitors searching the Site receive results presented in a clear and informative manner.
The Company may, at its discretion and without liability to the Client, remove from the Site any listing that violates these rules. The rules may change from time to time.

11 - RESPONSES TO ADVERTISEMENTS

The Client agrees to deal fairly and professionally with individuals who may respond to the Client’s advertisement and not engage in any behavior that could damage the reputation of the Company or the Site.
The Company does not guarantee any responses to the Client’s advertisements or that the responses will be from suitable individuals for the advertised job.

12 - EQUIPMENT

It is the Client’s responsibility to ensure they have the appropriate equipment and are connected to the necessary services to post jobs on the Site.

13 - CONTENT AND LINKS

If the Client’s advertisement is linked to another website via the Company’s external apply online option, the Client is responsible for maintaining the links and the content of their advertisement and the linked website.
The Company may remove from the Site any advertisement that contains content or links to a website that, in its opinion, is defamatory, illegal, or objectionable, or that may damage the reputation of the Site.

14 - THIRD-PARTY WEBSITES

Jobs posted by the Client on the Site may also appear on third-party recruitment websites as per agreements between the Company and the owners of such websites.

15 - COMPANY CANDIDATE DATABASE

  • Database Rights: Database rights and all other applicable intellectual property rights in the Candidate Database belong to the Company.
  • The Client acknowledges that it does not acquire any rights over the database or its content and that its retention and use of the database and its content are governed by these terms and conditions.


15.1 - Use of the Database

The Client may:

  • Use, search, or download information for their database with the aim of finding suitable candidates for specific job vacancies the Client or their Client (in the case of an employment agency) wishes to fill;
  • Use the information about individuals contained in the database to contact them (either directly or via the Site, depending on the product purchased) regarding a specific job vacancy;
  • Use the information solely in connection with the Client’s own recruitment activities.

The Client MAY NOT:

  • Supply, sell, or license material obtained from the database to third parties;
  • Download the database through any automated process (e.g., "scraping");
  • Contact individuals in the database or make any use of the information about those individuals other than for finding suitable candidates for specific job vacancies.
     

16 - DATA PROTECTION (LGPD & GDPR)

  • LGPD (Brazilian General Data Protection Law): The Company is committed to protecting the privacy and personal data of users, in accordance with the LGPD. Personal data collected will be used only for the purposes described in the Services offered and as per the Company's privacy policies.
  • GDPR (General Data Protection Regulation): If you are located in the European Union, you have the right to access, correct, erase, restrict processing, and port your personal data, as well as to object to processing and not be subject to automated decisions.


17 - DATA SUBJECT ACCESS REQUEST (DSAR)

Under GDPR, you have the right to request access to the personal data we hold about you. To request access to your personal data, send a letter including your full name, email address, contact number, address, and date of birth. Specify the type of request:

  • Access to personal data
  • Rectification of personal data
  • Deletion of personal data (Right to be Forgotten)
  • Restriction of processing
  • Data portability
  • Information on automated decisions
